Terms and Conditions
1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. Entry is open to all residents of Australia & New Zealand who subscribe. Employees of the Promoter and their immediate families and associated agencies with this promotion are not eligible to enter.
3. The competition commences on 20.08.08 at 00.01(AEST) and concludes on 01.10.08 at 10am (AEST). Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the draw. One valid entrant’s will be drawn at random to become the winners. The draw will take place at Belong Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000, on 13.10.08 at 11:30 am AEST. The winners will be notified by telephone and mail using contact details provided in their entry. Winners of prizes valued over $100 will be published in Street Machine on 12.11.08.
4. To enter, participants must call 1900 921 229 or send a text/SMS message to 1973 3444 or log onto www.streetmachine.com.au and register their details including vehicle selection, name, address, postcode, and daytime phone number and e-mail address. Entries to the 1900 telephone number must state the entrant’s vehicle selection, full name, address, and daytime telephone number. Entries to the SMS number must include their vehicle selection, entrant’s full name, address. SMS entrants will receive a reply message.
5. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.
6. UNIQUE CODES: Only one unique code per entry is permitted. Unrecognised codes will not be accepted. Participants may enter as many times as they like but only one entry per product purchased/unique code is permitted.
7. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
8. Inaudible, incomprehensible and illegible entries will be deemed invalid.
9. Multiple entries permitted but each entry must be sent separately and must abide by all entry requirements.
10. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
11. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
12. The time of entry will in each case be the time the 1900 telephone call/SMS message is received by the Promoters database. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.
13. Maximum entry cost is $0.55 (including GST). Higher rates apply to calls to the 1900 number from mobile phones. Service not available from payphones. The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider
14. The first valid entry drawn will be deemed the winner and will receive the major prize valued at up to $3650 (depending on point of departure). The prize includes a return economy class air flight for two from the winners nearest capital city to the Summernats Festival in Canberra worth up to $2000. Transfers from Canberra Airport at $200, two nights twin share accommodation for two worth up to $400.00, 2 X Summernats gold passes at $550, Street Machine Industry party at $300 and Street Machine merchandise at $200.
15. Total prize value is up to = $3650.00 (including GST)
16. Prizes cannot be transferred or exchanged and cannot be redeemed for cash.
17. The winner/s (and their companion/s) is/are responsible for all other expenses including spending money, meals, drinks, laundry charges, incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
18. The winner/s and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or Perth). (If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and travelling companion only – if applicable).
19. Government taxes are an additional cost to the winners and their travelling companions and are required prior to ticketing.
20. If the winner/s is under the age of 18 as at the date of the draw, the prize will be awarded the winners parent and/or legal guardian.
21. The prize must be taken by the 02.01.09 and is subject to hotel and flight availability. The prize cannot be changed once the booking has been made.
22. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
23. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to reference to all relevant state and territory Regulation and legislation.
24. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
25. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Street Machine or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
26. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
27. Prizes will only be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder). The winner will therefore be, in each case, the account holder.
28. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
29. Subject to any written direction given under regulation 37 of the Lotteries and Gaming Act 1993 (SA), an unclaimed prize draw will take place at Legion Interactive, Level 8, 155 George Street, Sydney NSW 2000 on 12.2.08 at 11:00 am AEST and winners of prizes valued over $100 will have their details published in the public Notices section of the Australian on 21.2.09.
30. FOR EVENT BASED PRIZES: Travel must be taken at the time specified by the promoter and must coincide with the dates of the scheduled Summernats Festival Travel must be taken between 02/01/09 and 04/01/09 at the time specified by the Promoter and must coincide with the dates of the scheduled Summernats Festival. If a winner and travelling companion are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.
31. The major prize is for the specified dates of the event only. If the winner resides in SA, the winner can transfer all components of the major prize and may nominate someone else to travel in his/her place if they are unable to accept the prize. If the winner (for whatever reason) is unable to travel or does not take an element of the major prize within the time stipulated by the Promoter, and, where the winner is from SA and is unable to nominate someone else to travel in his/her place, then the prize will be forfeited and cash will not be awarded in lieu of the major prize.
32. The promoter’s decision in relation to all aspects of this promotion is final and binding on all who enter and the promoter will not enter into correspondence regarding the Competition result.
33. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
34. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant (f) redemption of the prize; and/or (g) participation in the promotion
35. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
36. All entries become the property of The Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By entering the promotion, entrants confirm that they allow their details to be used for this purpose. If entrants do not consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
